UNDER NO CIRCUMSTANCES WILL HRDCOIN BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HRDCOIN ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; AND/OR (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN.

3. Modifications to the Service and to this Agreement

HrdCoin.com reserves the right to make changes to the Service and to this Agreement at any time without prior notice. You are responsible for regularly reviewing this Agreement so that you will be apprised of any changes. Your continued use of the Service after such modifications have been made constitutes your acceptance of such modifications. If you do not agree to any change to this Agreement, then you must stop using the Service.

4. General Terms

This Agreement constitutes the entire agreement between you and HrdCoin regarding your use of the Service and supersedes all prior or contemporaneous agreements, understandings, negotiations and discussions, whether written or oral, between you and HrdCoin. If for any reason a court of competent jurisdiction finds any provision of this Agreement to be unenforceable or invalid, that provision will be enforced to the maximum extent permissible by applicable law and the other provisions of this Agreement will remain in full force and effect. This Agreement does not confer any third-party beneficiary rights.

You agree that: (i) the Service shall be deemed solely based in Luxembourg; and (ii) the Service shall be deemed a passive one that does not give rise to personal jurisdiction over HrdCoin either specific or general, in jurisdictions other than Luxembourg. Notwithstanding the foregoing two sentences with respect to the substantive law, any arbitration conducted pursuant to the terms of this Agreement shall be governed by the Federal Arbitration Act (9 U.S.C., Secs. 1-16).

This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you without the prior written approval of HrdCoin.com but may be assigned by HrdCoin.com without restriction. Any attempted transfer or assignment in violation hereof shall be null and void. This Agreement will bind and inure to the benefit of the parties, their successors and permitted assigns.

No agency, partnership, joint venture, employment or franchise relationship is intended or created by this Agreement. Headings used in this Agreement are for reference purposes only and shall not affect the meaning of any terms herein. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this Agreement.

The section titles in this Agreement are for convenience only and have no legal or contractual effect. Notices to you may be made via either email or regular mail. HrdCoin.com may also provide notices of changes to this Agreement or other matters by displaying notices or links to notices generally on the Service.

This Agreement, including without limitation the Privacy Policy, constitutes the entire agreement between you and HrdCoin with respect to your use of the Service and any other subject matter hereof, and supersedes all prior understandings and agreements between the parties regarding that subject matter. If any provision of these Terms is found invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
